Do you actually need full probate in California?

Most people assume an inherited house means a year of probate. California has a way around it that is more generous than almost anyone expects. It is based on the value of the home itself, not the whole estate.

  • A primary residence up to $750,000 can skip full probate

    This applies when the person who died left real property in California that was their primary residence, with a gross value of no more than $750,000. Once 40 days have passed since the death, the successor may petition the superior court to determine succession to that property. They do not need letters of administration or to wait for probate of the will. The figure is adjusted periodically.

  • The court order is what moves title

    If the court makes the required findings, it issues an order. The order says the property passes to the petitioners and sets out each petitioner's interest in it. That order is the document that lets title transfer.

  • Smaller estates have an even simpler route

    Separately, a successor may collect property by affidavit, with no letters of administration at all. This applies when the gross value of all the person's real and personal property in California is no more than $166,250, adjusted periodically. At least 40 days must also have passed since the death.

Before you accept a year of probate, check the house against the $750,000 primary-residence limit. Gross value means the full value, not your equity, so a mortgage does not bring you under it. If you are under, the petition route is much faster and cheaper. The earliest it can start is 40 days after the death.

    In the United States, inherited property generally gets a stepped-up cost basis. That basis is its fair market value as of the date of death. It can change the whole picture.

  3. Find out whether probate is actually required

    Not every inherited house has to go through full probate. It may pass outside probate entirely. That can happen if it was held in a living trust or owned jointly with right of survivorship. A transfer-on-death deed can do the same. Some states also offer a simpler process for smaller estates. Knowing which one applies can change your timeline by months.

  4. Every heir on title has to sign

    If the house passed to several siblings, all of them are on the deed. All of them must sign to sell. That is not a problem. It just means the conversation needs to happen early.
