What Texas law requires before your house can be sold

Texas foreclosures are famously fast, but the statute still hands you two separate notice periods that must run one after the other, and it fixes the sale to a single predictable day of the month.

  • The sale can only happen on the first Tuesday of a month

    A sale under a power of sale must be a public auction held between 10 a.m. and 4 p.m. on the first Tuesday of a month, at the county courthouse or an area the commissioners court has designated. If that Tuesday falls on January 1 or July 4, it moves to the first Wednesday.

  • First you get at least 20 days to cure the default

    For a home you live in, the mortgage servicer must first send written notice by certified mail stating you are in default and giving you at least 20 days to cure it. Only after that period can a notice of sale be given at all.

  • Then the notice of sale must run at least 21 more days

    Notice of sale must be given at least 21 days before the sale date, three ways at once: posted at the courthouse door, filed with the county clerk, and served on you by certified mail. These two periods run in sequence, so the cure period is not part of the 21 days.

  • The county has to publish the notice on its website

    Counties must post the filed notice of sale on a public county web page along with the date, time, and location, viewable without charge or registration. If you cannot find your paperwork, the county website is a place to check.

  • A sale can be rescinded within 15 days if the default was already cured

    A mortgagee or trustee may rescind a completed nonjudicial sale of residential property within 15 calendar days where, among other grounds, the statutory requirements were not met or the default was cured before the sale.

What that means for you

The practical value is that a Texas sale date is knowable in advance and always lands on the same day of the month. Work out which first Tuesday yours falls on, then count backwards. Both notice periods have to complete before that date, and a cash sale that closes first pays the loan off and leaves any surplus with you.

Why a normal listing often does not work in time

A traditional sale has to survive showings, an appraisal, and a buyer's loan underwriting. That is typically 30 to 60 days after you find a buyer, on top of however long the house sits on the market first. When there is a scheduled sale date on the calendar, that timeline is the problem. A cash purchase removes the lender from the buyer's side entirely, which is what makes a short, certain closing possible.

What to know

  1. You keep the equity above what you owe

    This is the part lenders never volunteer. If the house is worth more than the loan balance plus fees, that surplus belongs to you, not the bank. If the property goes all the way through a foreclosure auction, that surplus is far more likely to be eroded by fees and penalties, or tied up for months in a claims process.

  2. Foreclosure timelines are set by state law, not by your lender

    Some states run foreclosures through the courts, which takes considerably longer. Others allow a non-judicial process that moves much faster. Two people the same number of payments behind can be in very different positions depending on where the house is. Get the actual sale date in writing before you assume how much time you have.

  3. Reinstatement and payoff are different numbers

    Your lender can quote a reinstatement figure, which brings the loan current, and a payoff figure, which closes it out entirely. A sale needs the payoff number. Request it in writing early, because it includes fees and accrued interest that a monthly statement does not show.

  4. A recorded notice is public, so expect the mail to start

    Once a notice of default or lis pendens is recorded, it becomes public record and lists get sold. The volume of letters and calls that follows is not a signal that your situation is desperate. It only means a public record exists. Take your time and compare what each of them is actually proposing.
