Where Berkeley County handles deeds, taxes and estates

The County Clerk is in Suite 103. The Clerk records all documents, so your deed and any deed of trust are filed there. The same office handles wills and estates, which is where an inherited house usually starts.

The Assessor, in Suite 106, sets the value your tax is based on. The Sheriff collects the tax. The sheriff is also the county's treasurer and collects state, county, city and school taxes (W.Va. Code 7-5-1). Court cases are heard at the Berkeley County Judicial Center, 380 West South Street.

Foreclosure in Berkeley County runs through a trustee

Most West Virginia mortgages are deeds of trust. If you default and the lender asks, the trustee can sell the house at a public auction (W.Va. Code 38-1-3). No judge has to order that sale first. That is why the timeline can feel short if you fall behind.

Before the auction, the trustee has to publish a notice in the county as a Class II legal ad (W.Va. Code 38-1-4). That means once a week for two weeks in a row (W.Va. Code 59-3-2).

You also get a copy by certified mail at the address in the deed of trust. The notice must give the time and place of the sale.

Unpaid Berkeley County property taxes end up with the State Auditor

The Sheriff's tax office mails real estate tax tickets each July. The county's example for an unpaid 2021 ticket:

  • mailed July 15, 2021
  • to the State Auditor November 1, 2022
  • set for auction March 1, 2023.

To pay it off at that stage, the county says you owe two years of taxes with interest and charges. You also pay a fee of 7.5% of the taxes, capped at $120.

The Auditor sets the list of lands for sale between March 1 and August 1 (W.Va. Code 11A-3-44). The Auditor then auctions the tax lien at the county courthouse within 90 days of that list (11A-3-45).

Even after the sale, you can still get the house back before a tax deed is issued. You pay the Auditor what is due, plus 1% interest per month and the buyer's costs (W.Va. Code 11A-3-56).

What Berkeley County taxes a home and a deed in 2026

The Assessor values property at 60% of market value. The 2026 levy sheet sets the rate for owner-occupied homes (Class II) in the rural districts at 1.2094 per $100 of assessed value.

By our math, a house worth $200,000 is assessed at $120,000 and owes about $1,451 a year at that rate. Inside Martinsburg, the city's rate is 1.5516, so the same house would owe about $1,862, again by our math.

If you are 65 or older, or permanently and totally disabled, the first $20,000 of assessed value on the home you live in is tax free (W.Va. Code 11-6B-3). Berkeley County takes applications in person at the Assessor's office between July 1 and December 1.

The county notes that your heirs do not pay back the exempted taxes after you die.

When a deed is recorded, the state charges a tax of $1.10 per $500 of value (W.Va. Code 11-22-2). The county adds its own tax, set at 55 cents per $500. A county commission may raise that to as much as $1.65.

The seller usually pays these taxes, unless the buyer agrees to take the deed with them unpaid. Ask the County Clerk what rate Berkeley County charges today.

Wells, septic, karst and flooding in Berkeley County

Well and septic permits come from the Berkeley County Health Department. Before a house is built, the county's building permit rules ask for them, or for a letter from a utility saying service is available.

In West Virginia, you need a permit from the local health department before a private well is drilled, changed or closed. Only a licensed driller may drill it.

A 1995 U.S. Geological Survey study found that part of Berkeley County sits on carbonate rock. Karst, the land of sinkholes and springs, has formed there, and groundwater levels swing more.

Flooding happens too. The National Weather Service counts 162 floods on Opequon Creek near Martinsburg since records began in 1936. The county links to FEMA maps and the WV Flood Tool so you can check a parcel.

The cancellation certificate is then recorded with the county clerk, like a deed. From then on, the home is sold only as real estate, together with the land and any liens on it.

The Berkeley County Assessor treats a mobile home on someone else's land as personal property, taxed at 60% of its value. If you live in the home on rented ground, it can still qualify for the homestead exemption.
