Trustee sales and tax liens, step by step

Under a West Virginia deed of trust, the lender can have the trustee sell your house at public auction after a default (W.Va. Code 38-1-3).

Before that sale, the trustee runs a legal ad in Harrison County. You also get a copy by certified mail. The ad has to show the time and place of the sale (W.Va. Code 38-1-4).

After the auction, a trustee report of sale is filed. The County Clerk posts the disclosure form that goes with it.

Unpaid tax runs on these dates:

  • by September 10, the Sheriff lists land unpaid on September 1
  • October 31, the liens go to the State Auditor (W.Va. Code 11A-3-2)
  • March 1 to August 1, the Auditor certifies the list (11A-3-44)
  • within 90 days, the lien sells at the courthouse (11A-3-45).

If your lien sells, you can still redeem before a tax deed is issued, with 1% interest a month (W.Va. Code 11A-3-56). Liens that do not sell can go to a neighbor, the town, the county or the state land bank (11A-3-48).

The Assessor's 2026 levy sheet gives each district's rate as a percent of assessed value. Assessed value is 60% of market value.

Class 2 rates for owner-occupied homes on the 2026 sheet:

  • outside any town: 1.1309%
  • Clarksburg, Shinnston, Stonewood and Nutter Fort: 1.5059%
  • Bridgeport: 1.4893%
  • Lost Creek, Anmoore, Salem and West Milford: 1.3809%

The homestead exemption takes $20,000 off assessed value for owners 65 or older, or totally and permanently disabled (W.Va. Code 11-6B-3). New applicants file from July 1 to December 1. The Assessor says an heir who lives in the house may qualify.

Recording a deed brings a state tax of $1.10 per $500 and a county tax of at least 55 cents per $500. The seller pays unless the buyer accepts the deed unpaid (W.Va. Code 11-22-2).

After the August 2026 flood

Severe storms and flooding hit Harrison County from August 15 to 17. The county was then approved for FEMA Individual Assistance under Disaster Declaration 4953.

The deadline to apply is December 7, 2026. A recovery center is set for the Bridgeport Municipal Building. FEMA may help with costs your insurance does not cover, so the county says to apply even if you are insured.

If you plan to sell a flooded house, keep photos of the damage and your repair receipts. The county asks every owner to do the same for FEMA.

The county Planning Department handles floodplain permits under a 2014 ordinance. It also offers a loan to help owners tear down run-down buildings. Call 304-624-8690.

Gas rights, farm land and mobile homes

If someone else owns the oil, gas or coal under your land, the Assessor taxes those rights to that owner (W.Va. Code 11-4-9). Harrison's Assessor runs its own oil, gas and minerals division at 304-624-8523.

Farm land can be valued on its farm use if you apply by September 1 each year. In general you need 5 or more acres producing $1,000 a year, or under 5 acres with $500 in sales.

Here, a mobile home on land you own is taxed as real property. One on someone else's land is personal property. To join the home to the land for good, you can cancel its DMV title and record that with the Clerk (W.Va. Code 17A-3-12b).
