Your deed, your tax bill and your estate file in Muskogee

Most county offices you need sit at 400 West Broadway in Muskogee, the county seat. The Assessor is in Room 210 and the Treasurer is in Room 220. The County Clerk works in the same building.

Each office has its own job:

Probate and civil court records are kept by the Court Clerk, not the County Clerk. The Court Clerk's office is on the second floor at 200 State St. in Muskogee.

A Muskogee County foreclosure needs a judge first

In Oklahoma, a lender cannot sell a mortgaged house without a court judgment that orders the sale. The sheriff of the county where the land sits makes the sale (12 O.S. 686).

Notice of the sale must be mailed to you at least 10 days ahead. The sale cannot happen sooner than 30 days after the first newspaper notice. The sheriff may also choose to run the sale online (12 O.S. 764).

Then a judge holds a hearing to confirm the sale. You must get mailed notice of that hearing at least 10 days ahead (12 O.S. 765).

After a judge confirms the sale, the court can tell the sheriff to put the buyer in the house. This order is called a writ of assistance (12 O.S. 686).

Sometimes the sale brings in more than the debt, interest and costs. The sheriff must then pay you the extra when you ask for it (12 O.S. 773). A real estate attorney can confirm what applies to your case.

Pay before the bidding starts at the June tax resale

Property tax runs on a state calendar. Here are the dates:

  • November 1, the bill comes due
  • January 1, the whole bill is late unless half is paid
  • April 1, the second half is late (68 O.S. 2913).

Late tax builds interest of 1.5 percent a month, until the interest equals the unpaid tax (68 O.S. 2913).

Between April and the end of September, the Treasurer lists late taxes in a local paper for two weeks. A letter also goes to the owner on record (68 O.S. 3106).

If real estate taxes go unpaid for three years or more, the treasurer must sell the land. The sale is on the second Monday of June (68 O.S. 3105).

You can redeem the land any time before the resale auction starts. The current version of that law took effect November 1, 2025 (68 O.S. 3113). The Muskogee County Treasurer told owners to pay by 9:00 a.m. on June 8, 2026, to be safe.

Personal property taxes have a deadline too. Unpaid 2025 personal property taxes were due by 4:30 p.m. on May 11, 2026. After that, the owner's name could be printed in the paper.

The Treasurer's site posts a 2026 resale excess list and a claim form. It is worth checking if your land sold at the resale.

Muskogee County tax levies and the five homestead options

Your rate depends on your school district. In 2024 levies, the county ranged from 76.22 mills in Wainwright to 114.77 mills in Haskell. The report lists a mean of 96.58 mills.

In 2025, Assessor Ron Dean listed five exemption types:

  • single homestead
  • double homestead
  • permanent double homestead
  • senior valuation freeze
  • disabled veteran exemption

You must live in the home and be on the deed. The filing deadline is March 15. A notice that your value went up gives you 30 more days (68 O.S. 2892).

In 2025, the senior freeze required someone on the deed to be 65 or older, with household income of $72,400 or less. The double homestead needs income of $30,000 or less (68 O.S. 2890).

The basic homestead takes $1,000 off assessed value (68 O.S. 2889). By our math, that saved $108.96 a year at the 2024 Muskogee city levy.

The state deed tax is 75 cents per $500 of price (68 O.S. 3201). We figured $180 on a $120,000 sale.

Three rivers meet here, and 2019 showed what that means

The Arkansas, Verdigris and Neosho rivers all come together in Muskogee County.

In 2019, the Arkansas River reached 46 feet between Fort Gibson and Muskogee. Major flood stage there is 34 feet. People in Webbers Falls left their homes as the river rose.

In April 2020, the Webbers Falls mayor said some flooded homes were simply left behind. She said homes in the 100-year floodplain with half or more damage had to be raised before people could move back in.

Oil, coal and mobile homes on Muskogee County land

The west side of the county is prairie on sandstone, with pockets of coal, oil and natural gas. The east side turns into the wooded Cookson Hills.

Minerals can be split off from the land. When the owner of split minerals dies, anyone who claims through that person can file an affidavit of death and heirship. It goes to the county clerk where the minerals are (58 O.S. 393).

A mobile home set on your own land can have its vehicle title cancelled. Service Oklahoma Form 756 does this for a $5 fee.

The county assessor must seal the form, and you have 60 days after that to file it. It works only if you own both the land and the home, with no active lien.

On septic, a DEQ-certified installer can check their own work. Other installs need a DEQ visit before the pipes are covered.

A homeowner who is not certified can put in a system, but only one a year. If an aerobic system is installed, the installer must maintain it free for two years.
